The article presents shortly description of Law on disciplinary responsibility of judges since its adoption. In order to achieve reform strategy, on justice sector at 01.01.2015 Law on disciplinary responsibility of judges came into force. Thus, legal rules adopted have created a new judicial framework of work and led to the consolidation of the judge, as well as its independence. Also, rules were introduced related liability of judges, which operate both in relation to constitutional provisions and those of special laws to ensure professionalism and efficiency to the proper functioning of the system. This liability does not remove regulated by law especially magistrates having exercised their bad faith or gross negligence. The way it works but this responsibility must be accompanied by adequate procedural safeguards to protect the independence of judges and avoid the institution of accountability as a means of pressure on them. The current legal framework provides grounds for disciplinary liability of judges for the commission by them of disciplinary offenses. |
