The purpose of this article is to analyse the evolution of the right to free assembly aft er the adoption of the Law on Assemblies in 2008. Th e new law that led to the repeal of the old one introduced new qualities and notions for the process of organizing and conducting public assemblies. Th e new principles and elements were developed in line with OSCE ODIHR standards and recommendations, the legal framework provided terms that were previously ignored or which the legislator had been wrongly interpreted the Constitution. Th e assembly authorization system has been dropped out. If until 22.04.2008 the organizers of the assemblies were to obtain a permit to hold the assembly, aft er the introduction of the new law, the system became an information system by submitting pre-declarations for holding public assemblies. Better regulation were given for simultaneous meetings, spontaneous meetings and those with a limited number of people, which provides another for organizing. Th e analysis contains an overview of the main stages of law enforcement practices. Th e article highlights the fi ndings of the European Court of Human Rights, which examined several cases with regard to the meetings under the new law procedures, as well as analysing the consequences of police administrative practices. |
