Articolul cuprinde un studiu asupra conceptului de mecanism intern de realizare a drepturilor și libertăților fundamentale ale omului, menit să asigure cetățenilor statului, instrumentariul necesar în vederea prevenirii sau înlăturării efectelor încălcării drepturilor garantate de normele constituționale. În sensul determinat prin această cercetare, mecanismul realizării drepturilor permite înfăptuirea transferului drepturilor fundamentale de la categoria de posibilități virtuale la cea de valori concrete. Acest transfer însă poate fi asigurat doar prin implicarea statului, a cărui scop fundamental în raport cu instituția analizată nu este altul decât asigurarea unei implementări efective și autentice a acestor drepturi și libertăți.

The article consists of a research of the concept of internal mechanism on guaranteeing and realizing fundamental human rights and freedoms designated to ensure the citizens of the state with the necessary toolkit for preventing or eliminating the effects of violation of rights which are guaranteed by the constitutional norms. In the meaning determined by this research, the mechanism on realizing rights permits performance of transfer of fundamental rights from the category of virtual possibilities to that of concrete values. But this transfer can be ensured only by the involvement of the state whose fundamental purpose in relation with the analyzed institution is to ensure an effective and authentic implementation of these rights and freedoms.

L’article comprend une étude sur le concept de mécanisme interne pour la réalisation des droits et libertés fondamentaux de l’homme, destiné à fournir aux citoyens de l’État les outils nécessaires pour prévenir ou éliminer les effets de la violation des droits garantis par les normes constitutionnelles. Au sens déterminé par cette recherche, le mécanisme de réalisation des droits permet le transfert des droits fondamentaux de la catégorie des possibilités virtuelles à celle des valeurs concrètes. Cependant, ce transfert ne peut être assuré que par l’implication de l’État, dont l’objectif fondamental vis-à-vis de l’institution analysée n’est autre que d’assurer une mise en oeuvre effective et authentique de ces droits et libertés.

Статья содержит исследование концепции внутреннего механизма достижения основных прав и свобод человека, призванных обеспечить необходимые инструменты для предотвращения или устранения последствий нарушения прав, гарантированных конституционными нормами. В смысле, определенном в этом исследовании, механизм реализации прав позволяет трансфер основных прав из категории виртуальных в категорию конкретных ценностей. Однако, такое изменение может быть обеспечено только при участии государства, основная цель которого в отношении анализируемого учреждения есть не что иное, как обеспечение эффективного и подлинного осуществления этих прав и свобод.
