Civil liability is one of the most important manifestations of legal liability. It has a very important role in ensuring the civil circuit. However, its foundations based exclusively on guilt are surpassed by the realities of life. The law enforcement of the objective liability has substantially changed the institution of tortious civil liability, in particular, by reinterpreting its traditional functions (educational-preventive and reparative). In the modernized novels of the civil legislation of the Republic of Moldova, there are also the stipulations of art.2003 Civil Code, that refer to the exclusion of the obligation of repairing the damage caused to the person. The exclusion of obligation ensues if the damage was caused to protect the fundamental values in a democratic society by disclosing information through media channels. Pursuing the purpose of protecting fundamental values in a democratic society, if the perpetrator acts in good faith and does not abuse subjective rights, he is acquitted of the obligation to repair the damage caused. The rule falls within the range of cases that remove the illicit character of the civil act causing damages with the exemption from payment of the caused damage.
