Rezumat | |||||||
The study represents a comparative analysis of constitutions of the European states regarding minorities. In addition to the citizens’ fundamental rights and freedoms, these states provide supplementary guarantees to citizens which are in minority to the main ethnic group, which is considered as titular nation of the social foundation. The constitutional practice when approaching this “positive discrimination” reflects it under different formulations in the constitutional texts. The analysis of constitutions show that no matter of the legal formulation and application of wording such as “national minority”, “ethnic minority”, “ethnic group” or without any specific formulation, main constitutional provisions relate to the application of principle of equality in rights and non-discrimination. |
