Testamentary freedom is the principle on the basis of which each person is free to decide on the elements of his patrimony for the time when he will not be alive. Holographic wills are recognized in some jurisdictions, but their acceptance and legal validity may vary. Some regions may have specific requirements or restrictions regarding holographic wills and may not be accepted in certain jurisdictions. It is essential to consult local laws or legal advice to understand the validity and acceptance of holographic wills in a particular area. While specific legal practices may evolve, in the Republic of Moldova wills must, as a rule, be drawn up in the presence of witnesses or in front of a notary public. The objective of the presented paper is to elaborate a deep and comprehensive study on all the issues related to the stability and analysis of the object as a necessary condition for the correct drawing up of the holographic will to ensure the transmission of the inheritance based on a legally drawn up will, i.e. under the law, which allows raising the level of knowledge in the given field and which will contribute to the correct application of the legislation, to the effective solution of the problems in the matter and, of course, to a better understanding of the subject, paying special attention to the comparison procedure, because we consider this way of research efficiency. |
