Rezumat | ||||||
The purpose of criminal punishment, namely the correction and resocialization of the convicted, can only be achieved by promoting a criminal justice system based on respect for human rights. According to the legislation in force, the penitentiary system operates in accordance with the principle of legality, respect for fundamental human rights and freedoms, impartiality and nondiscrimination, humanism, the rational application of the means of correction of convicts and the stimulation of a respectful attitude towards the law. Therefore, the penitentiary system has the obligation to identify, promote and apply, appropriately, the international and national provisions in the matter, which guarantee the rights of the individual, thus limiting any unjustified restrictions. Deprivation of a person's freedom does not mean depriving him of his fundamental rights and freedoms, guaranteed by both the Constitution and the international treaties to which the Republic of Moldova is a party. So, it is the state's obligation to ensure conditions so that detainees and detainees can benefit from them. |
