The legal guarantees enshrined in the Constitution of the Republic of Moldova, developed by the norms of Law 317/1994 on the Constitutional Court and the Code of Constitutional Jurisdiction 502/1995 ensure the independence and immovability of constitutional judges, and immunities provide them with effective protection against interference, pressure or potential political abuses. , other factors and authorities. The existing regulations, although apparently provide for the possibility of prosecuting the judges of the Constitutional Court, are not full of clarity and predictability, on the contrary - susceptible to arbitrary interpretation, making them problematic to apply in practice. This outlines an imbalance between established immunities, as a means of protection against political interference and other factors in the work of constitutional judges, and the idea of their liability in cases of abuse or gross negligence or in bad faith violation of legal and constitutional principles and standards. |
