Rezumat | ||||||
Separation of powers is a principle which is at base of the fundamental legislation through
which the representative form of government is emphasized.
The principle of „powers of separation” seems to become an important feature of
democracy, and, at the same time, guarantee for social liberty and person,s security in the
relations with government. Is this principle a simple dogma of constitutional politics or it
expresses a indispensable reality and urgent necessity?
Some political writers from the 18 th century, (namely Montesquieu), have expressed the
opinion that the representative system, without the separation of powers could lead to a
tyranny.
They said that a delegation of the state functions from the national part to a single body
would mean an only person or a group of people with unlimited power which will be a
threatening towards personal freedom.
According to these political writers the means for removing this danger is separating the
powers that is delegating the state functions to specific and independent bodies |
