Статья посвящена теоретическому исследованию особенностей правового статуса объединения совладельцев многоквартирных домов (ОСМД) в аспекте решения вопроса формирования эффективного механизма правового регулирования правоотношений в жилищной сфере с позиции осознания проблем, вызванных отсутствием инструментов и средств обеспечения безопасности собственников и иных владельцев квартир многоквартирных домов. По мнению автора статьи, безопасность должна признаваться не только принципом регулирования отношений правового статуса ОСМД, который должен быть доминирующим над интересами собственников квартир, но и быть элементом нормативного регулирования, обеспечивающим возможность реализации прав отдельных владельцев. Таким образом, безопасность должна быть признана одной из целей создания и функционирования ОСМД.

The article is devoted to the theoretical study of the peculiarities of the legal status of the association of co-owners of multi-apartment buildings (AJOAH) in the aspect of solving the issue of forming an effective mechanism for legal regulation of legal relations in the housing sector from the point of view of problems caused by the lack of tools and means to ensure the security of owners and other apartment owners of apartment buildings.
