В статье обоснована актуальность изучения института негласных следственных (розыскных) действий, исследовано их значение в борьбе с преступностью и роль в защите прав и свобод человека. Проведен анализ понятия негласных след-ственных (розыскных) действий. Отдельное внимание уделено рассмотрению института специальной розыскной деятель-ности в уголовно-процессуальном законодательстве Республики Молдова, проведено его сравнение с институтом негласных следственных (розыскных) действий в Украине. Осуществлен анализ соотношения негласных следственных (розыскных) действий с оперативно-розыскными мероприятиями по уголовно-процессуальному законодательству Украины. Выделены преимущества и позитивные аспекты негласных следственных (розыскных) действий. Сосредоточено внимание на отдель-ных проблемах уголовно-процессуального законодательства, связанных с регламентацией порядка получения разрешения и сроков проведения негласных следственных (розыскных) действий и даны предложения по их решению путем внесения соответствующих изменений.

In the article the topicality of the research of the institute of the secret investigative (detective) actions is substantiated, their significance in the fight against crime and role in protecting the rights and freedoms of the man is researched. The analysis of the concept of the secret investigative (detective) actions is carried out. The separate attention is devoted to the review of the institute of the special detective activity in the criminal procedural legislation of The Republic of Moldova, its comparison with the institute of the secret investigative (detective) actions in Ukraine was carried out. The analysis of the relation of the secret investigative (detective) actions with the operatively-search actions according to the criminal procedural legislation of Ukraine was followed out. The advantages and positive aspects of the secret investigative (detective) actions were allocated. The attention on the separate issues of the criminal procedural legislation that are related with the regulation of the order of the receiving of the permission and terms of conducting of the secret investigative (detective) actions is focused on and the proposals for their solution by adding appropriate changes are carried out.
