Rezumat

Статья посвящена принципу разделения властей, предусмотренному статьей 6 Конституции Украины 1996 года, и ее внутреннему механизму сдержек и противовесов. На основе конституционных норм и мнений отечественных ученых-юристов, политиков и историков права проводится анализ полномочий органов законодательной, исполнительной и судебной ветвей власти и системы сдержек и противовесов между ними. По результатам изложенного сделаны выводы о статусе высших органов государственной власти, представляющих отдельные ветви власти.

The article is dedicated to the principle of separation of powers under article 6 of the Constitution of Ukraine in 1996, and its internal mechanism checks and counterbalances. On the basis of constitutional norms and opinions of native legal scholars, politicians and historians of law, an analysis of the powers of the legislative, executive and judicial powers, and checks and counterbalances between them. As a result of the above-stated conclusions on the status of the supreme organs of state authority, which are separate branches of power.
