In the theory of criminal law and juridical psychology (legal psychology) there is still a pending/relevant issue of whether one should distinguish between such terms as «heat of passion» (criminal law sphere) and «physiological affect», (psychological sphere). Despite having a number of common features, the concepts of «physiological affect» and «heat of passion» have a series of divergences that makes it impossible for the terms to be a considered identical, such as their allocation to different scientific fields. The work determines the psychological essence of motives and objectives of conduct of a person who is in a hyper-affective mental state: motive is represented by the urge to defend legally protected interests which are violated by the future victim, while objectives are represented by the necessity to safeguard one’s own life or the life and health of one’s family, as well as restore relationships protected by the
criminal law by terminating their violation. |

Имея определенные общие черты, понятия «физиологический аффект» и «состояние сильного душевного волнения» имеют различия, что делает невозможным их отождествление: принадлежность к разным научно-практическим отраслям.
