The European Committee for the Prevention of torture and inhuman or degrading punishment or treatment (CPT) developed the institution of the proce-dural guarantees on non-application of torture in the standards and states transpo-sed it in the national legislation. This regulation contributes to the effective imple-mentation of the absolute ban on the application of torture. These guarantees differ in the dependence on the procedural-criminal stage, starting from detention and ending with the period of execution of the deprivation of liberty sentence. The gua-rantees applied at the detention of person could differ if it is carried out by the carabinieri. In this study, we aim to determine the role of the carabinieri in ensuring the observance of the rights of the detained person, in general, and of the procedural guarantees regarding the non-application of torture, in particular. We analyze the cases when the carabinieri may detain the person, the procedure to be followed, as well as the difference in the exercise of procedural guarantees in de-pendence on the procedural quality of the detained person.
