The article is dedicted to the problem of cybercrime victim’s guilt, in particular, to victim’s mens rea of cryptocurrency crimes. The author comes to the conclusion that not all victims of online pyramid schemes are as naive as it might seem at first glance. Many of them perfectly understand the essence of this scam, but are guided by the false ilusion of control of the situation or bias of a successful outcome. In fact, from the standpoint of criminal law’s mens rea, these cases fit into the concept of criminal recklessness. However, when analyzing the victim's guilt, it must be remembered that its criminal law and criminological significance differ from the understanding of this concept in relation to the offender. |
