Rezumat | |||||
At present, a prerogative of development of the Republic of Moldova is extensive practical implementation of the principles of the rule of law, which is refl ected by its capacity to ensure respect for human rights measured at the standards of the European Community. The criminal procedure implies performance of the procedural actions that inevitably aff ect the rights of the person involved in the judicial proceedings. The procedural status of investigating judge implies a multilateral approach to the circumstances of a concrete case in order to rationalize the limitation of individual’s rights, being at the same time a guarantor of legality. Assessing the opportunity to authorize special investigative measures during a criminal investigation is a basic task of the investigating judge, which is externalized in assessing the simultaneous compliance with the legal conditions externalized in the provisions of national law and the reasoning of the triple test set out in the ECtHR case law. By a fair assessment of the evidence constituting grounds for authorization of special investigative measures, the court provides protection against arbitrariness and ensures the proportionality between interference and common purpose of society. |
