Rezumat

At the base of this article stands the phenomenon of the insolvency of the enterprises in Republic of Moldova and problems that arise when this phenomenon obtaining a criminal character. More than that, after more than two decades of intense collaboration of the Republic of Moldova with the community structures, we have found the "opening of the borders" for the business environment as well. As a result, we noticed that the economic and financial difficulties of an enterprise may have the domino effect and may attract the financial collapse of international business partners. On the other hand, the continuous expansion of trade and the intensification of national and international investments are facts that tempts criminal subjects to obtain illegally the financial advantages, thus leading to new facts, including criminal facts. This determines the need to create a legislative framework that would respond to new situations, and would protect social and economic relations with neighboring states.
