Rezumat

The purpose of my survey consists in the research and legal analysis of the refugees rights, from the point of view of international law, refugee law as a part of the international System of Human Rights, and of the national law of the Republic of Moldova. In regard to refugees who seek for protection in the Republic of Moldova, there has to be mentioned that Moldova is a transit country. Many people coming from Asia have an intention to reach Western Europe. Presently there are about 280 refugees and asylum seekers living in Moldova. They come from different countries of the world, but mainly from the Russian Federation (Chechnya), Afghanistan, Iraq and Sudan. On 23 November 2001 the Republic of Moldova passed a law by which it accedes to the 1951 Convention relating to the Status of Refugees and its 1967 Protocol.[1] By acceding to the Convention, the Republic of Moldova became the 142nd State Party that assumed the responsibility to protect refugees pursuant to international standards.According to Article 1 of the Convention, "refugee" is a person "owning to well founded fear of being persecuted for reasons of race, religion, nationality, membership of a particular social group or political opinion, is outside his country of nationality (or former habitual residence in case of statelessness), and is unable or unwilling to avail himself of the protection of that country."[2] The Moldovan legislation guaranties to all refugees fundamental protection and rights such as: confidentiality, prohibition of expulsion or return, family unity, protection of children and naturalization, however they still face a lot of difficulties, especially when it comes to social acceptance or employment.
