В данной статье автор рассматривает значимость и необходимость создания Национального механизма предотвращения пыток в Республике Молдова и раскрываются основные проблемы его деятельности. Также анализируется роль Совета в правовой сфере Республики Молдова. Изучается влияние международных механизмов на совершенствование правоприменительной практики Совета, в том числе акцентируется внимание на практику Европейского Суда по правам человека (ЕСПЧ). Итогом работы является ряд существенных предложений для улучшения эффективности деятельности Национального механизма предотвращения пыток.

În prezentul articol autorul examinează importanța și necesitatea creării în Republica Moldova a unui Mecanism național de prevenire a torturii, precum și dezvăluie principalele probleme ale activităților acestuia. Este analizat și rolul Consiliului din sfera juridică a Republicii Moldova. Este examinată și influența mecanismelor internaționale asupra îmbunătățirii practicii de aplicare a legii, inclusiv accentul este pus pe practica Curții Europene a Drepturilor Omului (CtEDO). Autorul vine cu o serie de propuneri importante pentru îmbunătățirea eficacității Mecanismului național de prevenire a torturii.

I n this article the author examines the importance and necessity of creating in the Republic of Moldovaa a national mechanism for the Prevention of torture, as well as reveals the main problems of its activities. The role of the Council in the legal sphere of the Republic Of Moldova is also analyzed. The influence of international mechanisms on improving law enforcement practice is also examined, including emphasis on the practice of the European Court of Human Rights (EC tHR ). The author comes up with a number of important proposals for improving the effectiveness of the national mechanism for the Prevention of torture.

Dans cet article, l’auteur examine l’importance et la nécessité de créer en République de Moldovea un mécanisme national pour la prévention de la torture, ainsi que révèle les principaux problèmes de ses activités. Le rôle du Conseil dans le domaine juridique de la République de Moldova est également analysé. L’influence des mécanismes internationaux sur l’amélioration des pratiques répressives est également examinée, notamment en mettant l’accent sur la pratique de la Cour Européenne des droits de l’homme (CEDH). L’auteur présente un certain nombre de propositions importantes pour améliorer l’efficacité du mécanisme national de prévention de la torture.
