The subjective side of the offences stipulated in the art.238 and art.239 of the Criminal Code of Republic of Moldova is tackled in the present article. The author analyzes the two intentions (direct and indirect) that are characteristic for the guilt in case of obtaining a loan by means of deceit. Also, other types of intentions are analyzed, even if they are not differentiated in the Criminal Code. Besides culpability, the subjective side of the offence is characterized by reason and aim. The Criminal Code of Republic of Moldova does not contain definitions of „the reason of the offence” and „the aim of the offence”. The author considers them very important and therefore gives their thorough analysis. The advantageous conditions of crediting stipulated in different normative documents are presented. |
