In the article, it is argued that if the offence specified at par.(4) art.1852 PC RM does not involve the
causing of large-scale damages, the qualification may be made
under art.100 of the Contravention Code. In
accordance with Law nr.129 of Romania from 29.12.1992 on protection of the industrial designs and models,
it is not required the production of such damages. Further, it is stated that in case if the offence specified
at par.(5) CP art.1852 PC RM does not involve the production of large-scale damages, the qualification
may be made
under art.101 of the Contravention Code. In accordance with Law No.255 of Romania from
31.12.1998 on protection of the new varieties of plants, it is not required the occurrence of such damages. It
is also shown that if the offence specified at par.(6) art.1852 PC RM does not involve the production large-
scale damages, the qualification may be made
under art.102 of the Contravention Code. According to Law
no.16 of Romania from 06.03.1995 on the protection of the topography of the integrated circuit, there is not
required the production of such damages.
