In this article we intend to capture the essence of the institution’s general theory of the extinguishing obligations. We tried to render extinguishing obligations and the driving characteristics of the institution and later to obtain the overall definition of the juridical institution of extinguishing obligations. In their statement, we tried to explain the difference between certain legal terms that have a significant implication for the analysis of settlement obligations of the institution. In order to define the dynamic scope of the extinguishing of obligations, the actual processes were analyzed taking place at the completion stage of obligation and delivery of legal obligation that the parties bear. These dynamics aspects of obligations have been explained in relation to principles governing this juridical institution. |
