This article is on studying the legal generic object of the offenses on human trafficking in the comparative law. It is argued that even though the relation-value concept of the legal object of the offense is not designed in the legal systems of all the states, it is indisputable that the offenses classification in the Special Part of the penal laws of almost all the world states is depending on the offence’s legal object. Rather, it is depending on the fundamental social values representing the legal generic object of the offense. As well there is shown to be fully justified the separate incrimination of the offence on human trafficking and the one on child trafficking in different chapters of the Special Part of the Penal Code of the Republic of Moldova from 18.04.2002. |
