European Union law influences the substantive criminal law of the member states. In this area of law the protection of fundamental rights is indispensable, which means that the Charter has great relevance. This article examines the protection of fundamental rights within the EU in substantive criminal law since the Charter became binding and compares it with the protection offered by the European Court of Human Rights (ECtHR). |
