| Rezumat | ||||||
The safety measure of the obligation to medical treatment is provided by the provisions of art. 113 of the Criminal Code of the Republic of Moldova and concerns the state of danger arising from the abnormal psychophysical state of the perpetrator, generated by illness, chronic intoxication by alcohol, narcotics or other similar substances. In order to be able to take the measure of the obligation to medical treatment, it must be established by the judicial body that handles the case, that the condition, pathological or intoxication is such that it can be removed by means of this measure. The measure can be taken regardless of whether or not a punishment is applied to the perpetrator or even though it was applied, for example the prison sentence was suspended conditionally. |
