The idea of recognizing the legal person as a subject of crime and criminal liability has long been rooted in the common conscience of civilized mankind because it has found itself virtually unprotected from the negative consequences of market monopolization by national and transnational corporations, by the violation of the rights of consumers and employees, by the ignorance of the safety regulations in the production process, in transport and in everyday life. The evolution of the institution of criminal liability of the legal entity represented, over time, a justified attempt by the state to intensify the control over the nega-tive consequences of the business activity of the legal persons. It was during this period that the tendency of large-scale economic business to monopolization and ignorance, in the vast majority of cases, of the interests of the consumer and society, was suddenly manifested. Since then, an impressive doctrinal, legislative and practical experience in the field has been accumulated, but, despite this, a wide range of issues has remained unresolved. |
