The article examines the activity management of the prosecutor regarding implementation of such function as the representation of the state’s interests in the public sector under current conditions. Problematic issues of the prosecutor’s representation in connection with new legislative changes were defined. Established that the Law of Ukraine “On Prosecution” enshrined exhaustive list of conditions under which the prosecutor has the right to protect the legitimate interests of the state in the public sphere in court. In the absence of legislative changes aimed at expanding the powers of the prosecutor, may not effectively protect the legitimate interests of the state in this sphere in court.

У статті досліджено організацію роботи прокурора щодо реалізації такої функції, як представництво інтересів держави в бюджетній сфері в сучасних умовах. Визначено проблемні питання здійснення прокурорського представництва у зв’язку з новими законодавчими змінами. Установлено, що в Законі України «Про прокуратуру» закріплено вичерпний перелік умов, за наявності яких прокурор має право здійснювати захист законних інтересів держави в бюджетній сфері в суді. За відсутності законодавчих змін, спрямованих на розширення повноважень прокурора, неможливо ефективно захищати законні державні інтересів у цій сфері в судовому порядку.
