In the present article we tried to determine one of the modalities of acquisition of the right of common property in shares. It is more a modality of transformation from spouse’s common property to common property in shares. Also, we researched the situations, from legal practice, when it is possible to determine such goods like being the object of the common property in shares. The aim of the article is to make well-known such a method of transformation of spouse’s common property to common property in shares and to give a solution for the problems existing in the legal practice. As well, we made a comparative aspect with the provisions of the Romanian Civil Code to make a general point of view about other international regulations. Because there are different opinions in the legal doctrine about the legal nature of the goods being the object of the common property in shares in the period of time, from the end of the marriage till the division of the common goods, we tried to make a short review about the legal regulations from the national and international legislation. In the end of the research we mentioned about some conclusions important to be taken into consideration.
