The Republic of Moldova and Romania do not have a long history regarding the confidentiality and protection of personal data.The first reference to the right to privacy appears in the Constitution of the Republic of Moldova of August 12,1994, where Article 28 concerns the right to the inviolability of intimate, family and private life, and in article 4 it describes the human right and freedoms that are applied in accordance whit theUniversal Declaration of Human Right, with the pacts and other treaties to which the Republic of Moldova is a party.At the same time, in the Constitution, the latter article also provides for cases where there are inconsistencies between the pacts and treaties on fundamental human righs to which the Republic of Moldova is also part of its internal laws, the international regulations have priority. [11]In Romania, although prior to 1989, the right to confidentiality was recognized as a fundamental human right, it was frequently violated, especially by the intrusion of the Security.Unsecured searches, with or without a reason, the purchase of personal goods, journals or notes just because they would contain critical opinions of the regime in power, interception of the regime in power, interception and control of correspondence and telephone calls were common practices.Major changes in this area accur in Romania only after he December 1989 revolution.The first reference to the right to privacy also appears here in the Constitution adopted in 1991.Although the People’s Advocacy Institution was created by the Constitution in 1991, it prectically began its activity only in 1997 and was subsequentjy named as a data protection authority. |
