The author specifies the major problems, he solution without which the further development of the Moldovan state system is inconceivable. These necessitate a solution in the framework of the juridical basis of the state, Constitution and in conformity with the norms of the international law. It is considered that on the basis of the state law edification there should be the principle of separation of powers – the most efficient protection of democracy. In a democratic state in the centre of attention the should be the human being, with his/her rights and liberties, protected by the Constitution, the state in its turn, is part of the society and cannot develop separately from it. In spite of the fact that the values are different, first there should be the law.
