Rezumat

Age establishment to obtain some rights or some lost privileges is a complex problem. The Children Rights convention defines the child as a human being under the age of 18 years. The child has to be treated as a being who rejoices the definite rights and whose abilities are observed, taking into consideration his evolution, the fact implicated in the state obligation to protect him. Though, the Children Rights Convention presents a flexible definition, it identifies the child as a person who needs special protection, specifying childhood limits, contributing to the general conception unification of the notion “child”, which in general lines, but differently, was used in the national legislation.
