The phenomenon of piracy off the coast of Somalia, “endorsed” by the climate of instability in the area, has advanced in the last years. In the present international context, piracy has all the chances to be considered a problem of the scale of – the still unsolved – issue of terrorism. International law provides for the interested states the legal mecha-nisms, of customary and conventional source, needed for tackling the phenomenon. However, the manner by which the Security Council intervenes in this scene, in the virtue of its attribution regarding the maintenance of international peace and security, is interesting. In 2008, based on Chapter VII of the UN Charter, several resolutions were adopted regarding the Golf of Aden. The study of Security Council resolutions 1816/2008, 1838/2008, 1844/2008, 1846/2008 and 1851/2008 reveals the manner by which the subject is treated by the Security Council, and also the progressive evolution of the measures taken to com-bat piracy. The involvement of the Security Council in the issue reveals interesting aspect of international law that will be explored in the present paper along with the Internatio-nal Organization of the United Nations, the Security Council and their evolution. |
