In this article it is handled the issue of the delimitation of two related offences: the coercive offense of making statements and the offense of torture of inhuman or degrading treatment. The researcher assesses the issue as a complex one, less discussed in the doctrine of criminal law and which leads to an increased number of mistakes committed in applying those criminal law rules. In the study, the author’s opinion is motivated and according to it, the right qualification and trenchant delimitation of the stated offences it is necessary to be established both characteristics signs of each offence in question and the factual circumstances of a specific case. The resulting right will be identified as a unique accumulation of signs, analysed carefully in the content of this publication, which characterises each of the two offenses, and at the same time facilitates their delimitation.
