У статті розглянуто питання щодо місця права на експертну ініціативу в системі прав та обов’язків судового експерта в кримінальному провадженні. Підкреслено, що реалізація зазначеного права можлива за допомогою інших його прав, зокрема знайомитися з матеріалами справи, заявляти клопотання, бути присутнім під час вчинення процесуальних дій тощо. Визначено процесуальні підстави експертної ініціативи. Запропоновано виокремлювати зовнішню та внутрішню форми ініціативної діяльності судового експерта.

The article deals with the issue of the right to an expert initiative in the system of rights and duties of forensic expert in criminal proceedings. It is emphasized that the realization of this right is possible with the help of his other rights, in particular, to get acquainted with the materials of the case, to submit a petition, to be present during a procedural actions, etc. The are determined a procedural grounds of an expert initiative. The author offers to distinguish an external and internal forms of the initiative activity of a forensic expert.

Articolul abordează problema de expert în drept spațiu la inițiativa unui sistem de drepturi și obligații de expert judiciar în cadrul procedurilor penale.
