Rezumat

The declaration of the appeal implies a continuation of the trial of the case by the hierarchically superior court. The use of this ordinary remedy produces some effects that the criminal procedural law specifies. Thus, from the provisions of art. 408 – 411 CPC of the RM [1] results that the appeal has the following effects: suspensive, deductive, non-aggravating and extensive. Analyzing the devolution effect, we can mention that, according to the law, it is regulated as the court of appeal receiving the case, obtains the right to make a new judgment both on all aspects judged in the court of first instance, and on some of these. The limits of the devolution effect of the call are determined by the person who declared the call, the person to whom the call refers, the quality that the appellant has in the process. Of course, the prosecutor's appeal against the sentence pronounced in the criminal case also produces its effects.
