Rezumat | ||||||
The Constitutional Court guarantees the supremacy of the Constitution, which establishes the primary duty of the state to respect and protect the person. The state has the positive obligation to ensure the constitutional order in accordance with the supreme values enshrined in the Fundamental Law. In this sense, the Parliament regulates by organic law the crimes, the punishments and the regime of their execution. This attribution of the Parliament is not an absolute one and may be subject to constitutional control. |
