Rezumat

The judges’ independence and equality in the framework of the constitutional jurisdiction is ensured and realized by the free expression of their vote. In case of lack of unanimity, it becomes a necessity to express a separate opinion by the constitutional judge, who does not agree with the interpretation offered by the Court. The individual opinion of the constitutional judge, based on personal convictions and special knowledge, strengthens the clear comprehension of his role in exercising the constitutional jurisdiction, in elucidating intricate subjects of constitutional norms’ interpretation. Because it is a constitutive part of the act adopted by the Court and needs to be enclosed to it. The publication of the separate opinion of the constitutional judge, together with the adopted act, contributes to the strengthening of society’s confidence in Court fidelity regarding the principle of insuring the Constitution supremacy in its independence from political power.
