From the point of view of procedural autonomy, international trade arbitration is defined as a jurisdiction derogating from the common law of the jurisdiction, being also conceived at the same time as a method of resolving international trade disputes. International trade arbitration bases its autonomy by focusing on the parties to the dispute, international custom, universal principles of law, recognized in most countries of the world, and as auxiliary sources of law - usually court decisions, binding on all parties to the dispute. The relations appeared in connection with the settlement of economic disputes between the subjects of public or private international law, are the object of study of the autonomy of international commercial arbitration in the process of achieving international economic law, including in terms of jurisdiction. |
