Law is a social phenomenon and the translation of a legal text refers to the transfer of a product into another culture which poses many difficulties to the process of translation. Problems of (mis) understanding appear not only while translating from one language into another one, but also due to the diversity of legal systems of the states that have the same official language. This statement explains the need of several stages in translation of a legal text: the first being decoding of information at the level of a language and a society, while the second one is the translation of the text and its adaptation to a new linguistic and social and legal reality.

Dreptul este un fenomen social, iar traducerea unui text legislativ semnifică transpunerea unui produs într-o altă cultură, proces ce transformă traducerea într-o operaţie cu numeroase dificultăţi de diferit ordin. Însă, nu doar traducerea dintr-o limbă în alta cauzează probleme de (ne)înţelegere, ci şi diversitatea sistemelor juridice ale ţărilor în care circulă aceeaşi limbă de stat. Această constatare explică necesitatea mai multor etape în traducerea unui text juridic: prima etapă va constitui decodificarea informaţiei la nivelul unei limbi şi al unei societăţi, iar la etapa a doua vom realiza traducerea şi adaptarea textului la o nouă realitate lingvistică şi sociojuridică.
