У рамках даної статті проведено аналіз рішень Суду Європейського Союзу, в яких були сформовані дві підстави для можливого виправдання обмежень економічних свобод внутрішнього ринку: концепція імперативних вимог загального характеру, а також повага реалізації основних прав людини. В обох випадках обмежувальні заходи будуть визнані допустимими лише за умови дотримання ними принципу пропорційності.  

In terms of this article it was analyzed the decisions of the Court of the European Union in which two grounds were formulated for a possible justification of restrictions in the free economic on the internal market: the concept of imperative requirements of a general nature, as well as respect for the realization of basic human rights. In both cases, restrictive measures will be admissible only if they comply with the principal of proportionality.
