Președintele este o figură proeminentă în stat. Importanța acestei instituții a dreptului constituțional poate fi apreciată prin determinarea și evaluarea competențelor președintelui statului. În doctrina juridică, nu există o opinie unanim recunoscută cu referire la locul șefului statului în cadrul autorităților publice centrale. Unii savanți consideră că președintele statului este reprezentant al puterii executive, deși alții susțin că este un mediator al puterilor în stat. Scopul prezentului articol este de a realiza o retrospectivă a prerogativelor șefului statului, pentru a-i analiza locul în cadrul ramurilor puterii de stat.

The President is an important figure in the state. The importance of this institution of the constitutional law can be determined in the process of analyzing the President’s rights and abilities. In the legal doctrine, we cannot find an opinion recognized by all researchers that refers to the position of the President in the branches of the state power. Some scientists think that the President is the part of executive power, but others claim that he is a mediator of powers in the state. The purpose of this article is to analyse the President’s prerogatives, to analyse his place in the state’s branches of power and to find the best way of choosing the President in our country.

Le président est une personnalité éminente de l’état. L’importance de cette institution de droit constitutionnel peut être évaluée en déterminant et en évaluant les pouvoirs du Président de l’état. Dans la doctrine juridique, il n’y a pas d’opinion unanimement reconnue en ce qui concerne la place du chef de l’état au sein des autorités publiques centrales.
