From the content of the definition given to the suspect in Article 63 paragraph 1 of the Criminal Procedure Code of the Republic of Moldova, we understand that the attribution of suspect status could also be achieved in other cases than those expressly referred to Article 63, paragraph 1, points 1-3 from the same code. The practice of criminal prosecution confirms this approach. In the theoretical publications, the consequences of criminal prosecution were assessed when the national authorities had plausible reasons to suspect a person to commit a crime. According to the jurisprudence of the European Court of Human Rights on the interpretation of the notion of criminal accusation, the acquisition of suspicion becomes ex lege when the conditions requiring the judicial body to establish the existence of a criminal charge are fulfilled, to order further prosecution criminal charges against the suspect and to make his rights known to him. The author proposes, based on the analysis of the national legislation and the jurisprudence of the European Court of Human Rights, the adjustment of some provisions of Article 63 of the Criminal Procedure Code of the Republic of Moldova to the provisions of Article 6, paragraphs 1 and 3 of the European Convention for the Protection of Human Rights and Fundamental Freedoms. |
