In the framework of this article, it is carried out a comparative successive examination between the offence prevented in the art.286 PC RM and the taking hostage offence (art.280 PC RM), the mass disorder offence (art.285 PC RM), the hooliganism offence (art.287 PC RM), the ruffianism offence (art.283 PC RM) etc. Among other things, it is reached the conclusion that there can not be a „part-whole” relationship between the idioms: public order and public security. Emerging even from the Chapter XIII title of the Special Part from the Penal Code we find out that the legislator conceived as individualities these two social values. And the notions which denote them are narrowly complementary. However, their meaning never interpolates. |
