The investiture of notarial acts with enforceable form is a procedure that results from the delegation of the notary with powers of public authority. This particularity is evidenced by the final character of the notarial acts, which become mandatory for the recipients. The act enforced by enforceable formula is imposed on the executing bodies as a final act which, by itself, engages in the coercive force of the state and is executed as a court decision. In the legislation of the Republic of Moldova, the execution of a notarial act can be done in two situations: the conclusion of mortgage contracts and the conclusion of transactions in a mediation process. By way of comparison, we emphasize that in Romania, the enactment of notarial acts with enforceable formula is rarely used, because the documents authenticated by the notary public are executory titles themselves, without the need for an enforceable formula
