Article is intended to substantiate the concept of judicial power, taking into account interference doctrinal theories and concepts presented in the literature. It talks about the analysis process of building the rule of law and the principle of separation and balance of powers. Author browse fluent enlightenment theories describing conceptions of the rule of law to the rule of law meaning in the contemporary era. So that concludes that the interpretation of the judiciary has two directions, the material - which is the system of organs by laws called to participate in the application of the judicial process and functional - what are work direct examination in the trial of cases. |
