The constitutional right to social protection can be achieved in two ways: non-state and state protection. Note, however, that the non-state forms of social protection refer to private pensions, which are voluntary or mandatory accumulated savings and contribute to private pension funds, and are regulated by law. At present, the following forms of organizing the state social protection prevail in the Republic of Moldova: social insurance from C.N.A.S. funds; social insurance directly from the state budget; state social benefits. In this article we present the legal regulation of these forms of organizing the state social protection.
