Our research analyzes the case when a public oficial in good faith, during the exercise of duties, became aware of the content of such documents describing the ilegal activities of upper hierarchy officials, and considering that the information given is of public interest and could have a beneficial effect (e. g.: could lead to fighting corruption etc.), disseminate this information to the media. According to Art. 23 (5) of Law 158, „public officials cannot be sanctioned or penalized for reporting in good faith on the department head’s illegal orders”. However, this provision appears to be too bleak for proper elucidation of such a complex phenomenon called „whistleblowing”. Therefore, the good faith of the public oficial may have eventually not a too happy end regarding his/her public function, so it would require prompt elucidation of some strongly safeguards. So, taking the Guja v. Moldova [GC] case as a reference, tehre is underlined the principles of civil servant’s freedom of expression in such a case. |
