Binding character of international law rules lies in the decision of their authors firstly states to respect and to provide them binding. It is unlikely that states develop by consensus, or accept rules over time have become common character with intent to infringe. Once a rule of international law is justified in terms of the interests of the international community and is perceived as such by members of the international society, its compliance is not based primarily on coercion, penalties. |
