Rezumat

Given the severity of the effects of anti-competitive agreements on the competitive environment, the economic environment and public order, the legislator expressly declared the nullity of such agreements. The absolute nullity of anticompetitive agreements can be invoked by any interested party, as well as ex officio by the court. Moreover, the court is obliged to state it ex officio after hearing the views of the participants in the trial. Absolute nullity occurs by law, but in practice the nullity of anticompetitive agreements is to be found by the court. The Competition Council may mention this in its decisions and in the public communications concerning the adoption of that decision following the model of the European Commission, which tends to alert parties and third parties to the lack of effect of an agreement that has been declared to be in contradiction with the imperative provisions of the competition law.
