The identification of the qualifying solutions in case of falsifying the electronic documents is the subject of the present article. The author analyzes the problem by bringing into discussion the opinion of different scientists, the stipulations of the Law of Republic of Moldova with regard to the electronic document, digital signature and the Criminal Code of Republic of Moldova. The study brings us to the conclusion that the penal law has sufficient potential for the efficient punishment of a deed falsifying the electronic documents (including by means of falsifying the digital signature). Therefore, the completion of the Criminal Code of Republic of Moldova is not necessary, in order to distinctly incriminate the mentioned deed.
